TERMS & CONDITIONS

The party herein agrees as follows:
For the purposes of these terms and conditions PAWright Pet Services, LLC will be referred to as “Pet Sitter(s) or Pet Sitter/Company.” All visits will be governed by all hereafter terms and conditions.

1. The client may make telephone, email, or text visit requests for services at any time. These will be approved based upon to Pet Sitter availability and approval from the Company.

2. Prior to or upon the pet(s) 1st visit, PAWright requires half (1/2) of the total set of visit fees be paid. Final fee determination will be determined after all the completed services have been performed in the case of any unplanned required services. Payment for any open balance is promptly due upon the final invoice date.

3. Due to the complexity of scheduling, visit(s) requests made less than 24 hours of the needed visit(s) may be subject to a $10 late notice fee. The Company reserves the right to apply the fee on per case basis.

4. Visit(s) canceled within 24 hours of initial scheduled visit(s) may be subject to the fee for the initial visit. The Company reserves the right to apply the fee on a per case basis.

5. In the event Client returns home early, Client must notify Pet Sitter and Company in advance of Pet Sitter performing services regarding the scheduled visit to avoid being charged for an unnecessary visit(s).

6. Pet Sitter/Company will make every attempt possible to be at the client's home at a specific arrival time(s). That may not always be possible due to other scheduling conflicts, sitter availability and other unforeseen conditions such as, but not limited to traffic conditions. Client to choose a general time for the visit(s) to take place. Upon agreement, we will attempt to make the visit(s) during the generally agreed times below.
- Morning visits 8:00 AM-10:00 AM
- Noon visits 11:00 AM-1:30 PM
- Mid-Afternoon visits 2:00 PM-4:00 PM
- Evening visits 4:00 PM-7:00 PM
- Other set time visit determined in the interview with agreed upon fee

7. TOTAL FEE is determined on a per visit basis. To the extent, additional visits are requested or approved by the client, or otherwise authorized under Agreement of terms and conditions. The visit rate may be subject to change at the Company's needs.

8. KEY pick-up or drop off which requires a separate visit outside of the initial interview or pet visit there will be a minimum charge of $10 per trip plus $1.00 per mile from the Company. This rate is subject to change based on mileage or other requested services.

9. Pet Sitter is authorized to perform care and services as both the Pet Sitter/Company and Client have agreed. Both Pet Sitter and Client recognize that the welfare of the animal is the highest priority. If in Pet Sitter's judgment additional services become necessary during the service period to properly care for the animal, Pet Sitter will first make reasonable attempts to contact the Client. If Client cannot be contacted for whatever reason, Client authorizes Pet Sitter to undertake such additional steps as may in the reasonable judgment of the Pet Sitter be necessary or appropriate for the health and welfare of the animal, including but not limited to (a) additional visits by Pet Sitter to provide care for the animal; (b) consultation with Client's Veterinarian on file, or with an emergency veterinary care provider should Client's Veterinarian be unavailable; and (c) such other steps as may in the reasonable judgment of Pet Sitter be necessary or appropriate for the health and welfare of the animal including but not limited basic first aid and/or CPR. Client agrees to be responsible for all fees and expenses incurred for care and treatment of the animal pursuant to this paragraph, and releases and holds Pet Sitter harmless from all liabilities related to transportation, treatment, and expense. Client agrees to reimburse Pet Sitter/Company for any expense incurred, plus any additional fees for attending to animal's needs or any expenses incurred for any other home/food/supplies needed. Client hereby grants Pet Sitter a limited power of attorney for the specific purposes set forth in this paragraph.

10. In the event of inclement weather or natural disaster, Pet Sitter is entrusted to use the best judgment in caring for pet(s) and home. Client hereby holds Pet Sitter/Company harmless for consequences related to such decisions.

11. Pet Sitter agrees to provide the services stated in this contract in a reliable, caring and trustworthy manner. In consideration of these services and as an express condition thereof, CLIENT EXPRESSLY WAIVES AND RELINQUISHES ANY AND ALL CLAIMS AGAINST PET SITTER/COMPANY ARISING OUT OF OR RELATING TO THE PROVISION OF SERVICES HEREUNDER, EXCEPT THOSE ARISING FROM GROSS NEGLIGENCE OR WILLFUL MISCONDUCT ON THE PART OF PET SITTER/COMPANY. SHOULD PET SITTER OR ANY AUTHORIZED PERSON ACCOMPANYING PET SITTER SUSTAIN ANY INJURY, DISEASE OR OTHER HARM IN THE COURSE OF PROVIDING SERVICES HEREUNDER, CLIENT WILL INDEMNIFY PET SITTER/COMPANY AND HOLD IT HARMLESS WITH RESPECT TO ALL LOSS, EXPENSE AND DAMAGE CAUSED THEREBY, EXCEPT THOSE ARISING FROM GROSS NEGLIGENCE OR WILLFUL MISCONDUCT ON THE PART OF PET SITTER/COMPANY. Client has a duty to keep his or her property in a safe condition (including but not limited to making access to his or her home or place of service safe), and to warn Pet Sitter, its agents, employees and subcontractors, of any dangerous conditions on his or her property, including but not limited to his or her pet's history of violent or aggressive behavior. Client agrees to defend, indemnify and hold Pet Sitter harmless for any damage to Pet Sitter, its agents, employees and/or subcontractors, arising out of or related to Client's failure to comply with its obligations contained in this paragraph.

12. Client acknowledges that payment is due immediately upon completion of a scheduled service period without further invoice or notice. A late fee of $20 will be added to unpaid balances after 30 days. A handling fee of $35 will be charged on all returned checks. An advance deposit may be required whenever warranted in the sole judgment of Pet Sitter. In the event it is necessary to initiate collection proceedings on the account, Client agrees to pay for all of Pet Sitter's attorney's fees and costs of collection.

13. In the event of personal emergency or illness of Pet Sitter, Client authorizes Pet Sitter to arrange for another qualified person to fulfill responsibilities as set forth on this contract. In such a case, Pet Sitter will remain fully responsible for the proper discharge of all services under this Agreement. Every attempt will be made to notify client regarding such a situation.

14. All pets are to be current with all vaccinations.

15. Pet Sitter and Client each may terminate this contract at any time by written notice to the other. Pet Sitter will be entitled to payment for all services rendered until a notice of termination is received, and for any transition, services reasonably required to provide for the health and welfare of Client's pets. Pet Sitter will not terminate during a period of scheduled service unless Pet Sitter determines, in his/her sole discretion that a danger exists to the health or safety of Pet Sitter. If such concerns preclude Pet Sitter from providing further care of the pet, then Client authorizes pet to be placed in a kennel, with all charges therefrom to be charged to Client. Every attempt will be made to notify the Client regarding such a situation.

16. Pet Sitter is authorized to use one or more subcontractors or employee to perform the care and services as outlined in these terms and conditions. In such an event, the Company shall collect all fees for the performance of the care and services by the subcontractor(s)/employee and shall be Client's contact for the care and services provided by a said subcontractor(s). All protections and rights provided to the Pet Sitter in this Agreement shall also apply to any subcontractor and/or employee.

17. Client acknowledges through response to Company, he/she is providing approval for the provision of services by Pet Sitter during any service period scheduled by Client and accepted by Pet Sitter/Company. Upon such scheduling and acceptance, Pet Sitter/Company will be authorized to enter Client premises and perform services without additional signed contracts or authorization and to accept telephone, email, or text request reservations for future visits. Visit request and acceptance are based on sitter availability and subject to approval by the Company.

I have reviewed this Service Contract in its entirety. The information provided by me is complete and accurate and I agree to all its terms and conditions as set out above.

In order for any visit(s) to begin the Company must obtain Clients approval of these terms and conditions.

Client approval of these terms and conditions may be recognized by PAWright Pet Services via electronic but not limited to email response acknowledgment from the Client.
